TERMS OF USE


1. Acceptance of Terms

By booking or participating in any day tours offered by Cairns Citylink and accessing this website, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, please do not book or use our services.

2. Changes to Terms

We reserve the right to modify or update these Terms of Use at any time. It is your responsibility to review these terms periodically for changes. Continued participation in our day tours or use of our services after changes indicate your acceptance of the revised terms.

3. Booking and Participation

When booking and participating in our day tours, you agree to provide accurate and complete information. You are responsible for any charges incurred and agree to abide by the cancellation and refund policies outlined for each specific tour.

4. Tour Details

While we make every effort to ensure the accuracy of tour descriptions and itineraries, please note that details are subject to change based on weather conditions, unforeseen events, or any other factors beyond our control. We will make reasonable efforts to notify you of such changes in a timely manner.

5. Cancellation and Refund Policy

Each tour has its own cancellation and refund policy. Please review the specific policy for the tour you are interested in before booking. We will make reasonable efforts to process refunds in accordance with the policy.

6. Privacy and Data Security

Your privacy is important to us. Our Privacy Policy outlines how we handle and protect your data. By booking and participating in our day tours, you consent to the data practices outlined in the Privacy Policy.

7. Third-Party Services

Our day tours may include activities provided by third-party operators. We do not endorse, control, or assume responsibility for the content, safety, or practices of these third-party operators. Your interactions with these operators are governed by their respective terms and policies.

8. Limitation of Liability

Cairns Citylink is not liable for any direct, indirect, incidental, consequential, or special damages that result from your participation in our tours or use of our services, even if we have been advised of the possibility of such damages.

9. Termination

We reserve the right to refuse service, terminate your participation in a tour, or cancel a tour if deemed necessary for the safety, security, or enjoyment of other participants.

10. Governing Law

These Terms of Use are governed by the laws of the State of Queensland, Australia. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in Queensland.

GENERAL CANCELLATIONS & AMENDMENTS



1. All tours are governed by the laws of Queensland.

2. We strongly recommend acquiring travel insurance, though it’s not included.

3. Please allow a 15-minute window for the advised pickup time. Depending on road conditions, we may adjust the tour route or stop locations.

4. Children aged 4-14 inclusive. Children below 4 years travel for free unless stated otherwise and should be registered as infants.

5. For cancellations made over 72 hours before departure, you might be eligible for a refund, which, if approved, will be processed within 5 business days. Transaction fees aren’t refundable. 

6. Canceling bookings within 48 hours or no shows on the departure day result in a 100% cancellation charge.

7. Canceling group bookings that include pre-arranged entrance fees or meals within 72 hours of departure will result in a 100% cancellation charge.  

8. Groups failing to board will be charged the full cancellation fee.

9. Credit card payments attract transaction fees. We accept payment via Visa, Master Card, Amex, & PayPal which must be settled before traveling.

10. Tours don’t operate on Christmas Day. 

11. In the event of severe weather conditions, operations of the Kuranda Scenic Rail (KSR) or the Skyrail Rainforest Cableway may be suspended. In such cases, alternative arrangements will be provided for your convenience. Changing or canceling Gold Class bookings on the day of departure will result in a cancellation fee. 

12. Cairns Citylink retains the right to cancel any tour, modify the vehicle type, adjust the itinerary, or arrange for an alternative operator as needed.

13. Cairns Citylink is not responsible for passengers or their belongings if they aren’t present at specified locations and times, nor for any losses or damages resulting from such absences.

**While Cairns Citylink makes every effort to secure passengers’ belongings throughout the tour/charter and ensures that all items are collected upon disembarkation, it does not assume responsibility for lost property. If a passenger leaves an item on our vehicle, there are two options for its retrieval:

- Guests may personally visit our office at 196 McCormack St, Manunda, any day between 9 am and 5 pm to retrieve their item.

- If guests are unable to collect the item themselves, they can arrange for a courier service (we recommend Pack & Send) to pick up the item from our premises and deliver it to their designated address.

14. Prices may vary due to unforeseen circumstances, like increased supplier costs, fuel prices, taxes, or levies. If prices rise, we’ll give a minimum of 14 days’ notice.

       - Communicate with customer with important tour-related information, such as enquiries, bookings, travel services provided, problems and  complaints and to respond to any submissions, enquiries or requests from customers.

       - Make bookings and collect and make payments.

       - Improve our services based on customer feedback.

       - Manage and improve our business.

By providing us with your personal data, you consent to its collection and use as outlined in this statement. You may withdraw your consent at any time by contacting us.

We will use your personal information to send you marketing information, such as advertising and the details of promotions. You are free to stop receiving marketing information from us at any time by contacting us.


We only share your personal information with third parties crucial to fulfilling our services, such third parties may include any suppliers or sub-contractors, such as tour operators, coach operators, airlines or train companies or venues included in our tours, etc. 


We do not use or disclose your personal information to third-party marketing purposes unless we have obtained your consent to do so.


We will share your personal information with the insurance provider if you apply for travel or other insurance through us. Your information may be added to a claims register and could be shared with other insurers to prevent fraudulent activities.


We may also share your personal data with government or regulatory bodies when:

     - Legally mandated,

     - Necessary for the administration of justice,

     - Requested by public enforcement agencies, or

     - Needed for customs, visas, and immigration purposes.

We only gather such details in person, via our website, or over the phone when related to a booking you’re making or have completed.
